Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and FirstKnock ("FirstKnock," "we," "us") governing your access to and use of roofleads-eta.vercel.app (and any successor domain), our APIs, downloadable data, and any related services (collectively, the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old and able to form a binding contract under Florida law. You may use the Service only for lawful business purposes — primarily roofing-related sales, marketing, and outreach to property owners whose buildings carry permits in the relevant public records.

You are responsible for safeguarding your password and for everything that happens under your account. Notify us promptly at tpmccann88@gmail.com of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that create risk to the Service or to other users.

Paid plans are billed monthly in advance through Stripe, Inc. By subscribing you authorize recurring charges to your payment method until you cancel. Pricing for each plan is shown at checkout and may change with at least 14 days' notice for existing subscribers. Cancellation, credit rollover, and refund terms are described in our Refund Policy.

Subject to your compliance with these Terms and timely payment, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business operations. You may export unlocked lead records and use them to contact the listed property owners.

You will not, and will not permit anyone to:

• Resell, sublicense, redistribute, or publish the data made available through the Service in bulk or as a derivative dataset;
• Scrape, harvest, or use automated means to extract data beyond the Service's own export features;
• Use the data to contact property owners on the Do Not Call Registry without compliance with applicable telemarketing laws;
• Use the Service to harass, defraud, or send unsolicited communications in violation of CAN-SPAM, TCPA, or comparable laws;
• Reverse engineer, decompile, or attempt to access the source code of the Service;
• Interfere with the Service's operation, security, or integrity.

Lead records are derived from publicly available county property appraiser and municipal permitting records. We curate, normalize, and aggregate this information but we do not own the underlying records and we do not represent the data is current, complete, or error-free. Property ownership changes, permit data is filed and corrected on government schedules outside our control, and addresses may be inaccurate. You are responsible for verifying any lead before taking commercial action on it.

The Service, including software, UI, design, lead scoring, filtering logic, and aggregated presentation of public records, is owned by FirstKnock and protected by intellectual property laws. Nothing in these Terms transfers ownership to you. The underlying public records themselves are not owned by us.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROOFLEADS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DATA WILL BE ACCURATE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You will defend, indemnify, and hold harmless FirstKnock from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service in violation of these Terms, (b) your contact with property owners using information obtained through the Service, or (c) your violation of any applicable law.

You may cancel your subscription at any time from your account settings or by contacting us. We may suspend or terminate your account if you breach these Terms, fail to pay, or use the Service in a way that creates legal or operational risk. Sections 7 through 14 survive termination.

We may update these Terms from time to time. Material changes will be announced via email or a notice in the Service at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. The state and federal courts located in Duval County, Florida, have exclusive jurisdiction over any dispute arising out of or relating to these Terms.
